Nick Xenophon’s PR men are the key promoters of a self proclaimed hate group called Anonynous (a.k.a. Cyber Terrorists).

To back this up, poor Nick Xenophon is a Barrister and well knows the subject of the reliability of witnesses when presenting evidence.   This is odd for a barrister mounting an extraordinary attack on the validity of the High Court Of Australia ruling in 1988 that decreed The Church Of Scientology as a bona fide religion.  Why has Xenophon put his sworn oath to upheld the Australian Legal System in jeopardy?

Surely Xenophon knows all about the linkage of his right hand man and his previous employer at Channel & to the Anonymous hate group?

The most famous studies on the reliability of anti-religious witnesses, especially of apostates was done by Professor Brian Wilson deceased, previously Emeritus Professor Oxford University, in his published Article “Cults & New Religious Movements: Apostates – Apostasy – Apostate Syndrome:”

Xenophon and his media managers refused to communicate and investigate with The Church Of Scientology and instead pushed forward apostates.  According to Professor Brian Wilson’s work, the singular motivation for using apostates is media publicity.

The Australian Nov 21 2009 The Political Pursuit Of Religion: “The Prime Minister’s [ Kevin Rudd ] intervention raised my eyebrows. So I revisited the 1983 judgment of the High Court in Church of the New Faith v Commissioner of Payroll Tax (Victoria).”

The question as to whether Scientology is a religion was settled in the 1983 case. Scientology is a religion and its practice is protected under section 116 of the Constitution. The Church of Scientology is entitled to the same tax exemptions enjoyed by all religions, not the least Rudd’s Anglicans and my Lutherans.

There is nothing the government or the parliament [ including Nick Xenophon ] can do to withdraw the Church of Scientology’s status as a religion. Under our constitutional structure, it is the High Court that has the function of ruling whether Scientology is a religion and this it has done.

Why does Xenophon attack The Church Of Scientology?

All religions depend on their tax-exempt status based on the test case decision  handed down by the High Court in their 1983 judgment of the High Court in Church of the New Faith v Commissioner of Payroll Tax (Victoria).  The Church Of Scientology does not operate any businesses and relies solely on donations from its parishoners who do not receive tax deductions for their donations (except to building funds).

However, interests wanting to tax other religions must overturn the High Court decision defining The Church Of Scientology as a religion.  No other religion has been decreed as a religion by a High Court Ruling.

Being unable to claim The Church Of Scientology should be taxed, as it has no business profits to tax, Xenophon has resorted to publicly smear The Church Of Scientology and force a Senate Inquiry.  A Senate Inquiry as Xenophon knows does not have rules of evidence either.

So who is behind Nick Xenophon?  Ultimately the puppet master is yet to reveal himself.  However we do know his media managers are Rolan Ween, and Xenophon named Chanell 7’s “Today Tonight Brian Seymour in the Senate.

Late at night in the Australian Senate when only five other Senators were in the Senate (two of them asleep) Nick Xenophon launched his extraordinary attck on the Church of Scientolgoy as Plaintiff, Judge and Jury declaring The Church Of Scientology “an international criminal organization.”  Xenophon called for a Senate Inquiry which has no rules of evidence as any competent court would have.


The Articles of the United Nations Universal Declaration of Human Rights disregarded by Senator Nick Xenophon:

Article 8 – United Nations Universal Declaration of Human Rights.

* Everyone has the right to an effective remedy by the competent national tribunals for acts violating the fundamental rights granted him by the constitution or by law.

Article 10 – United Nations Universal Declaration of Human Rights.

* Everyone is entitled in full equality to a fair and public hearing by an independent and impartial tribunal, in the determination of his rights and obligations and of any criminal charge against him.

Article 11 – United Nations Universal Declaration of Human Rights.

* (1) Everyone charged with a penal offence has the right to be presumed innocent until proved guilty according to law in a public trial at which he has had all the guarantees necessary for his defense.

* (2) No one shall be held guilty of any penal offence on account of any act or omission which did not constitute a penal offence, under national or international law, at the time when it was committed. Nor shall a heavier penalty be imposed than the one that was applicable at the time the penal offence was committed.

As is quite well known The Church Of Scientology opposes the drugging of unborn children, pregnant mothers, and school children.  The Church of Scientology is often attacked by front groups acting on behalf of drug companies.  It is a fact well documented by the Church Of Scientology. Is it reasonable to assume that lurking somewhere behind poor Nick Xenophon, Brian Seymour and Rohan Ween are psychiatric interests?

Senator Nick Xenophon starts with a cry for taxing a religion funded by its members.

Senator Nick Xenophon does not see that the members have already been taxed, so he is calling for double taxation is it? The Church Of Scientology does not run any for profit businesses – all funds are raised from parishioners and this distinguishes it from other churches.

Then Senator Nick Xenophon presents his call for depriving a religion of its funds and that he is backed up by disgruntled ex-members of Scientology who admit to being traitors and enemies of the religion, having made choices and done things by their own hand that they later regretted.

It is as ridiculous as soldiers returning from war and unable to live with themselves for killing the enemy turn on their government and blame it for them choosing to become soldiers in the first place.

It turns out there is nothing new in Senator Nick Xenophon ’s allegations made.  The NSW police had already investigated and cleared the allegations made by the traitors already expunged from the religion.

As the Cape York Institute points out in The Australian yesterday there is no legal remedy available to Senator Nick Xenophon as the Constitution prohibits it.  Section 116 prohibits the Commonwealth from legislating against a religion.  The High Court has already ruled The Church Of Scientology a bona fide religion. The Church and its members dedicate their time and resources to numerous humanitarian programs that Scientology has become known for around the world, including combating drug abuse, immorality, illiteracy and human rights violations.

The European Court of Human Rights will overturn the French government’s attack on The Church of Scientology likewise, its another stunt.

The government and the taxpayers do not subsidise The Church Of Scientology – they have not received one cent from government sources – their parishioners fund the activities of The Church of Scientology. It is an untruth to say the Australian taxpayer funds The Church of Scientology.

So just what is behind of Senator Nick Xenophon ? – is he a puppet in this game?

Today the Senator Nick Xenophon inspired attack has broadened in The Sunday Telegraph to attack the United Nations Human Rights initiative to educate school children denied education by suppressive Education Ministries. The United Nations has mounted the biggest campaign in history to educate youth about the Universal Declaration of Human Rights.

All major religions in Australia help the UN with this effort to overcome the suppression of Human Rights education in schools by Education Ministries. It is also part of the effort to stop the drugging of school children with Ritalin and other medications paid for by national governments.

Government does fund the drugging of unborn children through financial support to groups like Beyond Blue to screen pregnant women for fake psychiatry diagnoses. Interesting to see as the players reveal themselves that people like Senator Bolkus are starting to show up in the debate out of the blue as reported in the Sunday Telegraph.

Our aim is also to support education of the right to one’s own sanity, and to protect humanity from psychiatric abuse and drugging.

Drug companies who maintain their products are able to treat the so-called “chemical imbalance in the brain” are philosophically opposed to Scientology. Drug companies are engaged in a massive drive world wide to medicate unborn children through their pregnant mothers and push for governments to allow the “screening” of pregnant women. Also mind, brain and psychiatric interests that promote the de-bunked ADHD syndrome in children are in opposition to Scientology.

The truth is that the government is funding the screening and drugging of children and pregnant women for many, many millions of dollars and The church of Scientology openly fights this with funds from its members, not funds from the government.

The government funds ex-politicians like Kennett’s Beyond Blue psychiatric backed group who are as we speak targeting and screening kids and pregnant women to drug them with psychotropic drugs funded by the government.

Senator Nick Xenophon pushed the toothpaste out of the tube about Scientology with a speech crafted in an obvious tone of hatred mixed with falsehood and attempts to re-open allegations of illegal deeds long ago cleared by police services.

Xenophon’s attack was intertwined with snide references to “so called religion” and openly stating that his aim is to deprive the fastest growing religion in the world of funds by calling for an inquiry into its tax-exempt status.

The Church and its members dedicate their time and resources to numerous humanitarian programs that Scientology has become known for around the world, including combating drug abuse, immorality, illiteracy and human rights violations.

Is there a rational basis for Nick Xenophon’s ranting attack on Scientology? – is it a publicity stunt? – or must the secret “Da Xenophon Code” be uncovered?

Surely Nick Xenophon’s assertions of crimes read to a near empty Senate Chamber late at night would perhaps  have been more suitable to suitable the goings on at a military base rather than a church.  There are no perfect organizations in the world that’s for sure.  Xenophon’s  speech was more an embittered and irrational rave by a closing attorney before an empty jury, rather than a seasoned and professional political senator amongst his peers.

In his first speech in the senate Independent Senator Xenophon said “…I do not swear allegiance to a party and that is why I do not owe allegiance to any one ideology. That is what I believe Independents must do. What is Xenophon’s Game Plan?

From a legal frame of reference The Australian Newspaper published an Article from the Cape York Institute for Policy and Leadership on Saturday November 21 stating the implausibility of a legal remedy against The Church of Scientology as the High Court of Australia has ruled it is a legitimate religion [ 1983 judgment of the High Court in Church of the New Faith v Commissioner of Payroll Tax (Victoria) ].

If the parliament has no legal powers in respect to deny Scientology as a religion, then what is Nick Xenophon really up to in his witch hunt?

To deny The Church of Scientology its tax-exempt status all other religions would have to re-classified as not being religions as well, this would include Anglicans, Lutherans, Catholics, Buddhists, Hindu, Moslem etc. And this is impossibility at any rate as the parliament has no power to legislate to change the status of religions.

So what is Nick Xenophon up to if there is no legal method to deny the religious tax-exemption from the inquiry he seeks against The Church of Scientology?

If Xenophon’s attack seeks to ban The Church of Scientology then all religions likewise would have to be banned. This is obviously an impossibility.

In his speech Nick Xenophon called The Church of Scientology a “so called religion” which is not true according to the High Court of Australia.

Nick Xenophon then stated his aim to be to deprive The Church of Scientology of its tax-exempt status, something Section 116 of the Australian Constitution prohibits.

What other legitimate motives could Nick Xenophon have in attacking Scientology?

For a lawyer by profession one would imagine Nick Xenophon would be able to deal in facts, not untrue assertions and character assassination of the world’s fastest growing religion The Church of Scientology.

So is it a publicity stunt by a man who is seeking to prove himself the dominator of the Australian Senate as he often holds the balance of power as an unaligned Independent Senator?

Perhaps it is, but a brutal attack on a religion firing bullets with such obvious hatred and falsehoods and no legal footing must backfire on Nick Xenophon in the end.

Maybe it is Nick Xenophon who is in self destruct mode?

The question as to whether Scientology is a religion was settled in the 1983 case. Scientology is a religion and its practice is protected under section 116 of the Constitution. The Church of Scientology is entitled to the same tax exemptions enjoyed by all religions, not the least Rudd’s Anglicans and my Lutherans.

There is nothing the government or the parliament [ including Nick Xenophon ] can do to withdraw the Church of Scientology’s status as a religion. Under our constitutional structure, it is the High Court that has the function of ruling whether Scientology is a religion and this it has done.

In their joint judgment, former chief justices Anthony Mason and Gerard Brennan made clear the inappropriateness of political leaders [ Rudd, Xenophon ] interfering with religious freedom: “Under our law, the state has no prophetic role in relation to religious belief; the state can neither declare supernatural truth nor determine the paths through which the human mind must search in a quest for supernatural truth.”

As to whether the teachings of Lafayette Ronald Hubbard make for a compelling religion or not, justices Mason and Brennan were clearly not credulous while maintaining a scrupulous objectivity, when they explained: “Yet charlatanism is a necessary price of religious freedom, and if a self-proclaimed teacher persuades others to believe in a religion which he propounds, lack of sincerity or integrity on his part is not incompatible with the religious character of the beliefs, practices and observances accepted by his followers.”

Dmitriy Guzner, 19, of Verona, New Jersey, who in May pleaded guilty to one count of computer hacking, was sentenced for his role in the distributed denial of service (DDOS) attack against Scientology websites. A DDOS attack occurs when a large amount of malicious Internet traffic is directed at websites, overloading their capacity and making them unavailable to legitimate users.

Church of Scientology websites were made unavailable to valid users for 24 hours, with the attacks continuing for 12 days, requiring the Church to hire a computer security company to protect against the attacks and to reroute traffic. Due to the severity of the crime, Judge Joseph Greenaway in U.S. District Court in Newark sentenced Guzner to the 366-day prison term, plus two years probation following his prison term, and ordered Guzner to pay $37,500 restitution to the Church

On October 31, another Anonymous follower, Brian Thomas Mettenbrink, 20, was indicted by a Grand Jury at the US District Court for Central California for the same attack on Scientology websites, for conspiracy and “transmission of a code, information, program, or command to a protected computer.” The indictment states that he obtained a computer program from an Anonymous website and executed a DDOS attack from his dormitory at Iowa State University against the Church computers in Los Angeles. He is awaiting sentencing. Canberra Tuesday 17 November २००९: Australian Independent Senator Nick Xenophon launched an attack and unilaterally declared the Church of Scientology “an international criminal organization” whilst calling for a Senate Enquiry into issues tabled in letters from disgruntled failed Scientologists publicly betraying their former religion. Why Senator Nick Xenophon chose to personally declare the fastest-growing religion in the world “an international criminal organization” in the Senate House before revealing the letters to Australian Federal or State police, or to the Church of Scientology for due process of police procedures is unknown and certainly boggles the mind.

Senator Nick Xenophon’s attack comes only weeks after the French Government sponsored a flagrant abuse of the European Court of Human Rights rulings by avoiding the freedom of religion rights granted to all religions within the Union by the European Parliament which were championed by the Church of Scientology.

Together with neighboring Germany that conquered France in World War II, both countries remain the strongholds for psychiatric front groups formed by the survivors of Hitler’s Death Camps where they had worked in supervising the genocide of the Jews, and who personally advised Adolf Hitler. These groups established the psychiatry profession in the western world infiltrating American universities funded by the Rockefeller Foundation. France has the highest per capita saturation of psychiatrists than any other country in the world and its government and society is effectively under the influence of entrenched psychiatric interests. In declaring the Church of Scientology “an international criminal organization” Senator Nick Xenophon flagrantly transgressed and breached many Articles of the Universal Declaration of Human Rights, in particular Articles 8, 10 and 11. United Nations Universal Declaration of Human Rights Articles disregarded

In usurping the power of the Australian Legal System in declaring the Church of Scientology “an international criminal organization” prior to any charges being laid by Australian Police, Senator Nick Xenophon is clearly guilty of a number of human rights violations in terms of the United Nations Universal Declaration of Human Rights, to which Australia is a signatory. Senator Nick Xenophon faces the possibility of a UN Human Rights Commissioner investigation in Australia after persecuting the Church of Scientology. International observers on humans rights watch see the attack as a disgrace on the Australian Parliament and blatant religious persecution.

Nick Xenophon, an independent senator, presented letters to the Australian Parliament from several self declared enemies of Scientology who openly admit to committing the crimes detailed in their own letters, and they admit to doing so willingly in their own right. Knowing this, Nick Xenophon, without any regard for the sanctity of the United Nations Universal Declaration of Human Rights launched his attack on the Church of Scientology.

Many see the attack as the trademark of a Tyrant attempting to establish a police state in a virtually empty Senate Chamber without due process of law. Nick Xenophon’s victims, Australian Scientologists, have promised to co-operate with any police investigation into claims of murder and abuse inside the church.

The Church of Scientology Fights Back

Church of Scientology Australia president Reverend Vicki Dunstan said Senator Nick Xenophon “made no effort to ascertain the truth or falsity of the allegations he made in the Senate on Tuesday night”.

Senator Nick Xenophon used parliamentary privilege to raise allegations of criminal misconduct on behalf of ex-members of the church, and called for an inquiry into the tax-exempt status of the church. Notably a common tactic used by psychiatric front groups in attempts to financially disable the Church of Scientology so it is unable to function.

The Government has said it will consider Senator Nick Xenophon’s request for an inquiry but the Opposition is not so keen.

Ms Dunstan accused Senator Xenophon of abusing parliamentary privilege to publicly utter false allegations concerning the church, which she said had been investigated by authorities in the past and had cleared the church of any wrongdoing.

“The church had recently invited the senator to meet with church representatives to answer his questions and to address any mutual concerns,” Ms Dunstan said today. “He ignored the invitation.” The alleged incidents voiced in the Senate on Tuesday came from disgruntled former members with their own agendas to put forward and were used by Senator Xenophon for “his own political aspirations”, she said.

The church says the invitation to Senator Xenophon to speak with church officials remains open.

The Articles of the United Nations Universal Declaration of Human Rights disregarded by Senator Nick Xenophon:

Article 8 – United Nations Universal Declaration of Human Rights.

* Everyone has the right to an effective remedy by the competent national tribunals for acts violating the fundamental rights granted him by the constitution or by law.

Article 10 – United Nations Universal Declaration of Human Rights.

* Everyone is entitled in full equality to a fair and public hearing by an independent and impartial tribunal, in the determination of his rights and obligations and of any criminal charge against him.

Article 11 – United Nations Universal Declaration of Human Rights.

* (1) Everyone charged with a penal offence has the right to be presumed innocent until proved guilty according to law in a public trial at which he has had all the guarantees necessary for his defense.

* (2) No one shall be held guilty of any penal offence on account of any act or omission which did not constitute a penal offence, under national or international law, at the time when it was committed. Nor shall a heavier penalty be imposed than the one that was applicable at the time the penal offence was committed.

Yet unlike real medical disease, there are no scientific tests to verify the medical existence of any psychiatric disorder or diagnoses. To counter this obvious flaw in their push to medicalize behaviors, the psychiatric industry will claim that there are certain medical conditions that do not have a verifiable test so this is why there isn’t one for “mental illness.” This is frankly a lame argument; Whereas there may be rare medical conditions that do not have a verifiable medical test, there are virtually no psychiatric disorders that can be verified medically as a physical abnormality/disease. Not one.

In fact the “brain scans” that have been pawned off as evidence that schizophrenia or depression are brain diseases, are simply bogus. Most have not been done on drug naive patients, meaning someone who has not been on psychiatric drugs such as antipsychotic drugs, documented to cause brain atrophy (shrinkage). Other brain scans have shown the brains of smaller children to show smaller brains in comparison to larger/older children and then claimed children with ADHD have smaller brains. None have been conclusively proven to verify mental disorders as abnormalities of the brain.

If there were such verifiable brain scans, or in fact any medical/scientific test that could show a physical / medical abnormality for any psychiatric disorder, the public would be getting such tests prior to being administered psychiatric drugs.

This is fact: There are no genetic tests, no brain scans, blood tests, chemical imbalance tests or X-rays that can scientifically / medically prove that any psychiatric disorder is a medical condition. Period.

This is not to say that people don’t get depressed, troubled, or even sometimes act psychotic. For example, can soldiers returning from war experience extreme and often debilitating stress? Yes. It is something wrong with their brain? No. It’s the horrors of war. Can mothers become distraught after a joyous occasion such as the birth of a child? Yes. Is it a brain abnormality or mental disease? No. And is the most humane solution to put these people on drugs documented by international regulatory agencies [ PDF "The Side Effects of Common Psychiatric Drugs" ] to cause mania, psychosis, worsening depression, heart attack, stroke, sudden death? Or for new or nursing mothers to risk birth defects or damage to their infants from being prescribed such powerful drugs?

The primary reason people take psychiatric drugs is because they’ve been told they have a medical condition called a psychiatric disorder, which then justifies taking drugs to treat it. This is a brilliant marketing campaign, but it is not science. Any drug changes behavior or mood, whether cocaine, alcohol, marijuana or heroin. This does not mean someone who acts or feels differently on cocaine does so because they had a cocaine imbalance which the cocaine then corrected. It means that drugs changes mood, emotion and behavior. But while the illicit use of drugs is universally frowned upon, and considered a bad way for people to deal with their problems, psychiatric drugs are made out to be “good” drugs, despite the fact many are more addictive than cocaine or heroin, and have side effects that rival such hardcore street drugs as LSD, heroin and crack cocaine.

The larger problem is that the biological drug model (based on the bogus mental disorders are a disease marketing campaign) prevents governments from funding real medical solutions for people experiencing difficulty. And there are workable, non-harmful medical treatments that do not receive government funding because the psychiatric / pharmaceutical industry spends billions of dollars on advertising and lobbying efforts, and will counter any medical modality that does not support their biological drug model of mental disorders as a disease. Why? Billions of dollars in revenue for the psycho / pharma industry would be lost. This is an industry that time and again, has been proven to put profit above patients lives.
